 CBFC - CENTRAL BOARD OF FILM CERTIFICATION Back

The CBFC (Central Board of Film Certification), popularly known as Censor Board is a quasi-judicial body coming under the control of the Govt. of India. Once a film is certified, the exhibition of the film in the cinema halls comes under the purview of the respective State Government. Therefore, enforcement of Cinematograph Act is the sole responsibility of the State law and order machinery, namely, the Police Commissioners, the Collectors and the SPs of the Districts. The CBFC does not have any special police force of its own to enforce the provisions of Cinematograph Act.

While the role of local police is important in checking violation, citizens need not depend on police alone for enforcement. Offences under Cinematograph Act being cognizable in nature, any responsible citizen or organisation can directly go to a police station to file a FIR against any cinema hall violating the law.

After a film has been examined and certified by the CBFC, the producer or the exhibitor:
(i)   may not implement the cuts ordered by CBFC
(ii)  may reinsert the portions which were not shown to the CBFC during certification
(iii) may insert a completely unrelated vulgar bit during exhibition

Mostly, interpolations can be easily identified by seeing the type of visuals themselves. However, in borderline cases of obscenity and violence, it may not be so. The CBFC does receive complaints that some of the scenes deleted by CBFC at the time of certification are reinserted during exhibition in the cinema halls. Such interpolations can be found out only by comparing the actual picture with the cut list. The cut list (technically called 'endorsement') is a list of deletions and amendments prescribed by CBFC as a pre condition to certification. The cut list ('endorsement') is expected to be displayed at a conspicuous place in the cinema halls. Non display of the cut list or copy of the Certificate is an offence.
